For every item of liability, whether an ox, a donkey, a sheep, or a garment, regarding any lost item about which he says, ‘This is it!’ to the court shall come both their claims.” (Exodus 22:6-8)The court must carry out the laws of the plaintiff, admitter or denier. (Rambam, Hilchot To’ein V’nit’an – The Laws of a Plaintiff and Defendant)
