Written by Machberes Avodas Hashem

Responsa-YahrtzeitThe 12th of Adar is the Yahrtzeit of Rav Chaim David Halevy (1924-1998). Sephardic Chief Rabbi of Tel Aviv for the last 25 years of his life, he was known to many as the author of the multi volume responsa Aseh Lecha Rav, on many contemporary halachic and hashkafic issues, and a six-volume halachic work entitled Mekor Chaim.

When I served in the Beit Din of Jerusalem, we had a case of a childless woman whose husband had passed away without leaving any children, and she therefore needed her deceased husband's brother to perform Chalitzah.

The Yavam was summoned to the court, however he refused to perform Chalitzah. He had heard that it was dangerous and therefore refused the supplication of the judges. The judges assured him that one who fulfills a mitzvah will not be hurt, but the man stubbornly refused to give in.

A few days later he appeared in front of the court and agreed to do Chalitzah. When the judges asked him what had caused him to change his mind, he explained that his deceased brother had appeared to him in a dream three nights in a row demanding to know why the man would not give him peace.

After he performed the ceremony, the judges requested that he inform them if he had any more dreams. He appeared a few days later to tell them that his brother had appeared again to thank him for giving him peace. (Asei l’cha Rav, Volume I, #54)
